Legal Age to Serve Alcohol:

 

21years of age with the exception that if 50% or more of a licensee’s gross revenue comes from the sale of food, then an employee who is 18-20 years old may serve, sell and/or dispense alcohol so long as there is another employee on the premises who is over the age of 21 but they may not tend the bar or draw or mix any alcoholic beverages.

Entry for Minors into a Liquor Establishment:

A person who is under 21 years old may not loiter on the premises of a licensed on-sale alcohol establishment.

Consent Laws (Parents Serving Minors):

 

Yes – but only if the minor is between 18 and 20 years of age.

Alcohol Service Hours:

 

On-Premise Establishments may sell and service alcohol Monday –Saturday from 7am to 2am. Some licensees such as restaurants may request the sale of alcohol on Sunday, which would be from 11am to midnight. On Sale Wine Licensees may sell and service alcohol Monday –Sunday from noon to midnight.

 

Off-Premise licensees such as Package Liquor Stores may sell alcohol Monday –Saturday from 7am to midnight. Sunday sales may be allowed by local ordinance. Off-Premise Package Beer and On & Off Sale Beer licensees may sell and service alcohol Monday –Sunday from 7am to 2am. 

 

No alcohol sales on Christmas Day or Memorial Day (except for malt beverages) - Local ordinances should always be consulted.

If a licensee has posted the proper notices warning customers, then they have the right to confiscate any false IDs and notify law enforcement.

Alcohol Service Restrictions on Time and Quantity:

There are no restrictions regarding happy hour, drink specials, etc. except that a licensee may not price any drinks below wholesale cost.

Penalty for Serving and/or Selling Alcohol to a Minor:

A licensee may face administrative sanctions and have to pay a fine:

·         First violation within a 2-year period: $500.00 (if trained) / $1000 if not trained by program approved by department.

·         Second violation within a 2-year period: $1000.00(if trained) / $2000 if not trained by program approved by department..

·         Third violation with 2-yer period may result in suspension or revocation of liquor license.
