Entry for Minors into a Liquor Establishment:

Not regulated by the state.

 

Generally, minors are permitted on the premises of any licensed establishment unless prohibited by house rules.

 

Local ordinances should be consulted.

 

Legal Age for Employment:

 

Generally 18 years of age although there is no minimum age for busboys or barbacks in On-Premise establishments. However, must be 21 years of age or older to be employed as a bartender.

Consent Laws (Parents Serving Minors):

 

Yes

 

Minors are permitted to consume alcohol under the supervision of a parent or legal guardian in a private residence. Minors are permitted to consume beer that has a 3.2% volume of alcohol or less when it is provided to them by a parent or legal guardian.

 

Licensees are never permitted to allow a minor to consume alcohol on the licensed premises even if a parent or legal guardian is present.

 

Alcohol Service Hours:

 

On-Premise Establishments may sell and serve alcohol Sunday – Saturday from 9am to 2am.

 

Off-Premise licensees and retail stores may sell alcohol Sunday – Saturday from 9am to 11pm.

 

Local ordinances should be consulted.

 

Acceptable ID’s:

 

A licensee may accept any valid government issued photo ID such as:

·         Drivers License

·         State ID Card 

·         Passport

·         Military ID

Confiscating False ID’s:

The state does not regulate this but does not recommend confiscating a person’s ID even if they believe it to be false. Licensees are encouraged to contact local law enforcement to deal with the situation.

 

Alcohol Service Restrictions on Time and Quantity:

Licensees are prohibited from:

·         Offering free drinks to customers.

·         Offering unlimited drink service for a single price.

·         Promoting any game that awards alcohol as a prize or encourages the consumption of alcohol.

 

Licensees are allowed to:

·         Offer a food and drink combination for a special price. The licensee must be able to determine and tell someone the separate cost of the food and the separate cost of the drink. The drink that was part of the combo must be available for purchase separately at that same price for the entire day and night.

 

Please note: All drinks have to have the same price throughout the same day and night.

 

Penalty for Serving and/or Selling Alcohol to a Minor:

It is a Class B misdemeanor that is punishable by a fine in the range of $200.00 to $1,000.00 and possibly up to 6 months in jail
